What is REACH? The council of the European Union has in the year 2006 put in place the REACH Regulation N°1907/2006. The text concerning chemical substances and dangerous mixtures aims to provide a better protection of the human health and the environment. All this is also to promote the innovation and the competitiveness of the European Industry. The REACH regulation is in place since 1st of June 2007. Esterline Connection Technologies (SOURIAU-SUNBANK), being fully aware of the obligations implemented with this regulations has set up a surveillance process for the manufacturing process and the utilization of chemical substances. Following the publication of the regulation 348/2013/EU, the use of chemical substances based on chrome hexavalents (CrVI) will be banned from begin of the 21st of September 2017 without having an authorization. REACH Authorisation: What impact for industry, SMEs and consumers?

Authorisation, one of the REACH processes for managing risks of substances of very high concern (SVHC), has the ultimate aim of phasing out SVHC of non-essential uses. In order to obtain an authorisation, companies must prove either that the risk to health and the environment is controlled or there are strong socio- economic arguments. After 5 years, it is important to draw some lessons from the efficiency of REACH, whilst at the same time reviewing the Risk Management part of the legislation. Given the authorisation costs, how can industry still be competitive throughout the entire supply chain? What will be the impact on SMEs? Is there a risk that authorization results in the allocation of critical parts of the value chain outside the EU, creating loss-loss situations for economics as well as environment & human health? How does the authorisation fit into the critical raw materials directive? Will the authorisation process be taking into account other legislative directives such as resource and energy efficiency? How are substances screened and shortlisted?

In late January every year approximately 200-300 substances are earmarked for manual screening by Member State experts based on an extensive set of algorithms to identify substances that may pose risk to human health or the environment. ECHA and Member State competent authorities are now in the third year of common screening. The short listed substances are grouped in terms of both the suspected hazardous properties and also the REACH/CLP regulatory process that may be the optimal next step. This webinar will explain the screening process, its timelines, and the criteria for short listing. The webinar also explains how registrants can influence the manual screening process by updating their dossiers and how they can obtain more information on common screening.

It contains the list of legally binding harmonised classifications (Table 3.1 of Annex VI to the CLP Regulation). The inventory has been established and is maintained by ECHA.

The presentation will give an overview of how in silico and other „new approach methodologies“ are implemented in European Chemicals law, i.e. REACH (Regulation (EC) No. 1907/2006 on Registration, Evaluation, Authorisation, and Restriction of Chemicals) and CLP (Regulation (EC) 1272/2008 on the Classification, Labelling, and Packaging of dangerous substances and mixtures, translating the UN GHS into European law). ECHA - The Use of Alternatives to Testing on Animals for the REACH Regulation

ECHA publishes a report on the use of alternatives to testing in animals for the REACH Regulation. Interview with Leena Ylä-Mononen, Director of Evaluation and Norbert Fedtke, Head of Unit of Evaluation about the findings of the report. REACH is clear that every effort must be made so that testing chemicals on animals is truly a last resort -- when there is no other scientifically reliable way of showing the impact on humans or the environment. REACH also demands that companies in possession of data on a chemical must share it (and share the cost) with any other companies making the same substance, thereby removing the potential for duplicate testing. With the adoption of the Better Regulation Agenda on 19th May, the European Commission is taking first concrete steps in the definition of its policy. This issue is expected to be heavily discussed in Parliament and Council in the following weeks, all the more since the Parliament has been very careful about the risk of better regulation being misused to remove environmental laws. There is a growing interest across stakeholders for the application of the better regulation approach to the management of chemicals. The Commission, the Parliament, the Council and the industry have started to look into a more consistent interaction between REACH and workplace legislation. Trade unions have been vocal about speeding up the process of implementing relevant workplace legislation, encouraging the Commission to adopt exposure limits for a number of chemicals. 􏰀 What are the most “burdensome” aspects of REACH authorization and how could they be tackled? 􏰀 How do exposure limits contribute to a safe management of chemicals? There are more than 100,000 of them out there, chemicals we mean, some of which we eat, or breathe or absorb through our skin. They are a part of nature, yet some are hazardous. Over 40,000 of them may pose a minimal risk – hence the growing need for European Union chemicals legislation which aims to generate information about impacts and protection against potential harms. The EU has therefore adopted a number of legislative instruments aimed at the control of chemicals across a range of commercial sectors. The focus of this monograph, as the subtitle indicates, is on REACH – the EU Regulation on the Registration, Evaluation, Authorisation and Restriction of Chemicals, which came into force in 2007. Its regulator, ECHA is the European Chemicals Agency. REACH, says the author is a daunting piece of legislation ‘one of the longest legislative instruments in the history of the EU’ and ideally requires a familiarity with toxicology to fully understand it, which is why, as the author suggests, it has engendered little in the way of significant academic writing. This book therefore does much to fill that gap and deserves full marks for the clarity of its writing and explanation. Then there is the subject of hybridity which is explained in a number of ways, including the existence of public and private regulation. Primarily however, the book concerns itself with the yoking together of hard and soft norms as the result of a shift to ‘new governance’ which will be familiar to governance scholars at whom the book is partly aimed. There is little doubt that legal practitioners, (especially environmental lawyers), consultants, academics and policy makers will come to regard this book as an important and accessible explanation of REACH and also an useful starting point for further research on EU chemicals legislation. The publication date is cited as at 2015.

It is expected to facilitate global trade and the harmonised communication of hazard information of chemicals and to promote regulatory efficiency. It complements the 2006 Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) Regulation (EC No 1907/2006) and replaces the current system contained in the Dangerous Substances Directive (67/548/EEC) and the Dangerous Preparations Directive (1999/45/EC).

This has prompted European Union regulatory authorities to launch a major chemicals testing program, known as Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH). Although the driving force behind REACH is ostensibly based on the precautionary principle, in practice, the evidence suggests that it is oriented more toward risk assessment than precaution. In addition, the test methods used to assess chemical risk also raise questions about the efficacy of REACH in achieving its stated aims of protecting human health and the environment. These tests rely in large part on animal models. However, based on empirical evidence and on well-established principles of evolutionary biology and complex systems, the animal model fails as a predictive modality for humans. In turn, these concerns raise significant ethical and legal issues that must be addressed urgently. Immediate measures should include a major biomonitoring program to reliably assess the chemical burden in European Union citizens as a means of prioritizing the most dangerous substances present in the environment. Blood and urine biomarkers are useful tools with which to implement biomonitoring and to help guide public policy. An ecological paradigm, based on pollution prevention, rather than pollution control and risk assessment of individual chemicals, represents a superior strategy, to prevent global chemical pollution and toxicity risks to human health.
