Senate investigates Nigeria's Petroleum Minister, Kachikwu, over alleged irregularities in oil, gas

The Senate on Wednesday mandated its Committee on Petroleum Resources (Upstream) to investigate issues relating to ongoing lease renewals in the oil and gas sector of the economy. It is believed that process is being undertaken by the Minister of State for Petroleum Resources, Dr Ibe Kachikwu and the Department of Petroleum Resources (DPR). The resolution followed consideration of a motion by Sen. Omotayo Alasoadura (APC Ondo) and three other senators. The motion was entitled “Irregularities in Ongoing Oil and Gas Lease Renewal and Massive Loss of Government Revenue”. Leading debate on the motion, Alasoadura said that the Committee on Petroleum Resources had since December, 2017 been inundated with petitions and complaints over alleged multiplicity of irregularities surrounding the renewal of oil and gas leases. He said there were also allegations that Kachikwu was granting illegal discounts and rebates in the exercise. Alasoadura added that “the action of the Minister of State is capable of short-changing the country and denying the Federation the appropriate revenue accruable from the renewal of the leases. “The Minister and the Department of Petroleum Resources were proceeding to renew leases of companies that had brazenly and illegally refused to pay royalties from oil and gas lifted by the companies in contravention of extant laws. “Under the provision of extant laws, failure to pay royalties is a ground for revocation of leases and a legal barrier to renewal of applicable leases. “There is a subsisting legal framework and due process mandated by extant law for the renewal of leases that are due,” he said.

Senate passes Petroleum Industry Bill, PIB

The Senate on Thursday passed the Petroleum Industry Bill, PIB, almost 17 years after the process started. With the passage of the bill, which is tagged, Petroleum Industry Governance Bill, PIGB, a new regulatory agency, known as Nigeria Petroleum Regulatory Commission, NPRC, would take over the functions of Petroleum Inspectorate, PI, the Department of Petroleum Resources , DPR, and the Petroleum Products Pricing Regulatory Agency, PPPRA. The new commission, among other things, will also administer and enforce policies, laws and regulations relating to all aspects of petroleum operations which are assigned to it under the provisions of the Act. With the bill is signed into law, two new companies, Nigeria Petroleum Assets Management Company and National Petroleum Company, would be established with certain assets and liabilities of Nigerian National Petroleum Corporation, NNPC, while the National Petroleum Company, for instance, would operate as a full independent commercial entity. According to the Senate, the move is geared towards unbundling the NNPC and the petroleum industry. In the PIGB, the Ministry of Petroleum Resources would be renamed Ministry of Petroleum Incorporated. In the new bill, upon the recommendations of the new commission, Minister of Petroleum Resources can grant, amend, renew, extend or revoke any licence or lease required for petroleum or production, pursuant to the provisions of the Act or any other enactment. The bill also proposed that when the commission is created, it shall be vested with all assets, funds, resources and other movable and immovable property, which immediately before the commencement of operation of the new commission, were held by the PI, DPR and PPPRA. In the bill, more powers will be vested on the commission, as the President or the Minister of Petroleum Resources, who hitherto had such powers, would no longer have same. The bill has significantly reduced the powers of the President and the Minister of Petroleum Resources in exercising control over the oil and gas sector. The newly passed bill would help promote transparency and accountability in the administration of petroleum resources of Nigeria as well as foster a conducive business environment for petroleum industry operations. The Senate is expected to pass two more bills to further regulate the oil and gas sector. Already, the Host Communities’ Bill, which has passed first reading in the Senate, is expected to be passed into law before the end of 2017. Thereafter, the Senate will also commence moves to pass another tranche of the bill that would deal with the fiscal aspect of the oil and gas sector. Corrupt practices’ll be reduced —Saraki In his remarks after the passage, Senate President, Bukola Saraki, who presided over yesterday’s plenary, noted that the Bill was not only for Nigerians but also investors. He said with the passage of bill, corrupt practices in the oil and gas sector would be reduced to the barest minimum, adding that the inefficiency currently associated with the sector would also be done away with. Saraki said: “The bill will stimulate the oil and gas industry; it will reduce the area of corruption and inefficiency in the oil and gas sector.” The bill will now be sent to the House of Representatives for concurrence before being transmitted to the President for assent.

- A total of 35 firms expressed interest to establish modular refineries in Nigeria - Less than half got the approvals from the department of petroleum resources as only 13 were given licenses - The government hopes to use the modular refineries to stop illegal refining of crude and also create employment in the Niger Delta region Out of the 35 firms that expressed interest to establish modular refineries, 13 have been given licenses by the Nigerian government. Maikanti Baru, the group managing director of the Nigerian National Petroleum Corporation (NNPC) made the announcement at the Offshore Technology Conference 2018 Nigeria Oil Industry Award Dinner in the United States, where he was the special guest of honour and received an award. According to him, the corporation and the Ministry of Petroleum Resources were collaborating to encourage the establishment of modular refineries in the Niger Delta to encourage job creation. Baru stated that in the months ahead, the dream of transforming Nigeria from a net exporter of crude oil to a net exporter of petroleum products would become a reality. He said he was committed to achieving the December 2019 target set by the federal government to end the importation of petroleum products into the country. READ ALSO: There is no president in Nigeria that has ever managed the economy like Buhari - Gov Ajimobi On efforts being made to refurbish Nigeria’s four existing refineries in Warri, Port Harcourt and Kaduna, the NNPC GMD said there is an ongoing arrangement with the original builders of the refineries to return them to at least 90% capacity utilisation before the 2019 deadline. He stated that the process for companies interested in the rehabilitation of the refineries using a contractor-financing model had been completed and successful and the companies for the different projects would be announced soon. “This model is expected to be a self-sustaining financial model with near zero reliance on the federal government funds. For smooth running and implementation, we are also changing the operating and commercial framework of the refineries to make them work efficiently and be commercially viable,’’ he said. In an earlier report by NAIJ.com, the the minister of petroleum resources, Ibe Kachikwu, said that the proposed modular refineries for Delta and Rivers states were not meant to address the current refining challenge faced by Nigeria. He said the modular refineries are expected to only produce an average 2,000 and 10,000 at most capacity per refinery while the average consumption of fuel by Nigeria stands at 630,000 barrels per day. Worried by the irregularities in the ongoing oil and gas lease renewal and massive loss of government revenue, the Senate on Wednesday mandated its Committee on Petroleum Resources Upstream to investigate the Minister of State for Petroleum Resources, Ibe Kachikwu and the Department of Petroleum Resources, DPR. The Senate resolved that the Committee should investigate all issues relating to the ongoing lease renewal being undertaken by the Minister and report the anomalies in the ongoing lease renewal process and identify appropriate measures to correct the said anomalies. The resolution of the Senate followed a motion titled, “Irregularities in the ongoing oil and gas lease renewal and massive loss of government revenue,” sponsored by Senator Omotayo Alasoadura (Ondo Central) and three others. Leading debate on the motion, Sen. The Department of Petroleum Resources (DPR) in Nigeria, saddled with the responsibility of ensuring compliance to petroleum laws, regulations and guidelines in the Oil and Gas Industry, is exploring the use of computer in its service delivery, with a view to ending some of the challenges in the sector. Seles providers often times are made to face time consuming processes, resulting in delay in product delivery, which has a multiplier effect on the availability of the product. On Channels Television’s programme, Sunrice Daily, on Tuesday, a senior official of the DPR, Mr George Osahon, said that with the computerisation, what sales providers in the industry do manually would be achieved with the use of a computer in their comfort zone within a short period of time. "We are going computerised. People will go online, fill the form, pay and even collect their certificates online. Everything is done online.
